
The Sylhet Labour Court has opened a new avenue for justice for the working class in Sylhet. On February 13, 2020, Honorable District and Sessions Judge Mr. Shahidul Islam assumed the position of Chairman of the newly established Labour Court and initiated its activities. With the introduction of the Sylhet Labour Court, workers previously under the jurisdiction of Chattogram’s second Labour Court can now file cases in Sylhet.
However, due to a lack of awareness, large working-class groups, including tea workers in Sylhet and Habiganj, are still deprived of these benefits. Yet, filing and pursuing cases in the Labour Court is much simpler compared to regular courts. The Sylhet Labour Court plays a significant role in raising awareness among workers and streamlining their processes for claiming rights.
Jurisdiction of the Labour Court
Under the “Bangladesh Labour Act 2006,” the Labour Court has both civil and criminal jurisdiction. Workers can file cases related to unpaid wages, unfair dismissal, accident compensation, gratuity, or provident fund matters.
Who Can File a Case?
The following individuals and organizations are eligible to file cases in the Labour Court:
Affected workers or trade unions.
Labour directors in cases of trade union fund embezzlement.
The trustee board chairman for crimes related to provident funds.
Competent authorities for apprentice-related offenses.
In other cases, the chief inspector or an officer appointed by them.
Case Filing and Hearing Process
Before filing a case in the Labour Court, the employer must be served with a notice. If the stipulated time for the notice expires, the aggrieved individual can directly or through a lawyer file the case. The court listens to the statements of both parties and delivers a fair judgment.
Lack of Awareness and Benefits
No court fees are required to file a case in the Labour Court. Additionally, the government provides free legal aid for those with financial constraints. However, many workers remain unaware of these opportunities, leaving them deprived.
Cases Related to Dismissal and Wages
In cases of dismissal, unpaid wages, or the closure of an organization, workers can easily file a case. If employers fail to provide a fair resolution, workers can seek justice through the Labour Court.
The establishment of the Sylhet Labour Court has opened the door to justice for workers in the region. However, increasing awareness among workers and ensuring active participation from relevant institutions and organizations are essential. This initiative will play a vital role in building a worker-friendly society.
